- Your Employee Offshore (Yempo) Inc, a registered company in the Philippines
- Yempo Trading (HK) Ltd, a registered company in Hong Kong
Yempo Group is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.
We have adopted the Privacy Principles outlined in the Data Privacy Act of the Philippines (DPA) and we also comply with the National Privacy Principles (NPPs) contained in the Australian Privacy Act 1988 (Cth) (the Privacy Act). These policies govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

2. Personal Information
2.1 What is Personal Information
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.
This Personal Information is obtained in many ways including interviews, correspondence, by telephone, email, via our website www.yempo-solutions.com. This information may also be sourced from your website or systems in use by our staff, assigned to your account, and from third parties. We don’t guarantee website links or policy of authorised third parties.
2.2 Why we collect Personal Information
We collect clients and suppliers Personal Information for the primary purpose of providing our services, providing information to our clients and marketing. We may also use client Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. Recipients may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.
When we collect Personal Information we will, where appropriate and where possible, explain why we are collecting the information and how we plan to use it.
Yempo employees assigned to client accounts that access Personal Information of our clients’ customers are bound by the same policies as for Yempo’s clients.
2.3 Do not track
Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.
2.4 Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive information will be used by us only:
- For the primary purpose for which it was obtained
- For a secondary purpose that is directly related to the primary purpose
- With client consent; or where required or authorised by law.
2.5 Third Parties
Where reasonable and practicable to do so, we will only collect Personal Information directly. However, in some circumstances, we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that owners are made aware of the information provided to us by the third party.
2.6 Disclosure of Personal Information
Personal Information may be disclosed in a number of circumstances including the following:
- Third parties where consent has been provided to the use or disclosure; and
- Where required or authorised by law.
2.7 Security of Personal Information
Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.
When Personal Information is no longer required for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify that Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by Yempo Group for a minimum of 7 years.
2.8 Access to your Personal Information
We will provide details of Personal Information held on request to update and/or correct it, subject to certain exceptions. If you wish to access Personal Information, please contact us in writing.
Yempo Group will not charge any access request fee but may charge an administrative fee for providing a copy of Personal Information.
In order to protect Personal Information, we may require identification confirmation prior to releasing the requested information.
2.9 Maintaining the Quality of your Personal Information
It is important to us that Personal Information is up to date. We will take reasonable steps to make sure that Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to clients.
3. Compliance with Policy
3.1 Privacy Officer
Yempo has assigned Riza Tendero as our official Privacy Officer, in line with the DPP, for ownership of this policy and regular Privacy Audits.
3.2 Employee Compliance
From September 2017 our employee contracts include a clause outlining Yempo employee compliance with both the DPP and NPP. Retrospective compliance will be complete by 1st October 2017.
3.3 Master Services Agreement
From September 2017 our Master Services Agreement includes a clause committing to compliance with the DPP and the NPP. Clients may request an updated MSA with this clause at any time.
